1. Who these terms are between
outfan.org ("outfan", "we") is operated by Pariette Inc., a Delaware corporation with a registered address at 8 The Green, Ste D, Dover, DE 19901, United States. By using the site or making any payment, you ("you", "the user") accept these Terms of Service. If you do not accept them, do not use the site.
2. What the service is
outfan is an entertainment website. It displays football clubs and offers, for each club, a set of purely decorative on-site positions: a presidency, a head coach seat, a capo seat, a captaincy and shirt numbers 1 to 99. Anyone may pay to hold a position. The holder's chosen handle, an optional short message, an optional square image and an optional link are displayed next to that position. A club's ranking is the total amount paid for its positions. Nothing else affects the ranking.
3. Eligibility
You must be at least 18 years old and legally able to enter into a contract. You must use a payment method you are authorised to use. You are responsible for complying with the laws of your own country when using the site.
4. What a position is — and is not
A position is a digital display slot that exists only on outfan.org. It grants no ownership, shareholding, membership, voting right, management right, authority to represent, licence, or any other legal or economic interest in any football club, league, federation, player, supporters' group or other entity. The words "owner", "president", "head coach", "capo" and "captain" are on-site display labels and carry no meaning outside this site. A position cannot be resold, transferred or assigned by you; it changes hands only through the bidding mechanism described in these terms.
5. Pricing and payment
The minimum amount required to take a position is at least ten percent (10%) above the amount paid by the current holder, rounded up to a whole unit. Payments are processed by Stripe. We never receive or store your card details. Prices may be displayed and charged in US dollars, euros or Turkish lira; the ranking is always calculated on the US dollar equivalent using the exchange rate in effect at the time of payment. You are responsible for any bank charges, currency conversion fees or taxes applicable in your jurisdiction.
6. No refunds
A position is a digital service delivered immediately upon payment. To the maximum extent permitted by applicable law, all payments are final and non-refundable, and you expressly waive any right of withdrawal that would otherwise apply to distance contracts for digital content. There is one exception: if your reservation expires and the position is taken by another user before your payment settles, the amount is refunded to you automatically.
7. Reservation and bidding
When you proceed to payment, the position is reserved for you for one hundred and eighty (180) seconds. During that window no one else can bid on it. If the window expires the reservation is released and the payment session is closed. Once you hold a position, another user may take it at any time by paying more. You have no right to retain a position, to be notified before it is taken, or to any compensation when it is taken.
8. Your content
You are solely and legally responsible for the handle, message, image and link you submit. By submitting them you confirm that you hold all necessary rights and you grant Pariette Inc. a worldwide, royalty-free, non-exclusive licence to display, store and reproduce that content on the site and in materials promoting the site, for as long as the content remains published. We are under no obligation to pre-screen user content.
9. Prohibited use
You may not submit content that is unlawful, defamatory, obscene, hateful, discriminatory, threatening, deceptive, or that infringes anyone's rights; that impersonates another person or organisation; that advertises unrelated goods or services; or that links to malware, adult material, gambling, or illegal content. You may not attempt to interfere with the site, circumvent its limits, automate bidding, or use it to launder funds or test stolen payment instruments. We may remove content, revoke a position and refuse service, without refund, for any breach of this section.
10. Third-party names and intellectual property
outfan is not affiliated with, endorsed by, sponsored by, licensed by or connected to any football club, league, federation, player or supporters' group. Club names appear as plain text, used descriptively and nominatively for the sole purpose of identifying which list is being referred to. No club crest, logo or other protected mark is used. Rights holders may request removal of any entry by writing to the address in section 16, and we will act on such requests promptly. All other content on the site is owned by Pariette Inc.
11. This is not gambling
outfan is not a betting, lottery, sweepstake, prize competition or game of chance. No prize, winnings, return, dividend or refund is promised or paid in exchange for any payment. Outcomes are not determined by chance or by any random element: the amount paid directly and deterministically decides the ranking, and this is known to you before you pay.
12. Availability, changes and termination
We do not warrant that the site will be available without interruption or free of errors. We may change, suspend or discontinue the site, any position, any club listing, or any feature, at any time and without notice. We may suspend or terminate your access if you breach these terms. If we discontinue the service entirely, positions cease to exist and no refund is due.
13. Disclaimer of warranties
The site is provided "as is" and "as available". To the fullest extent permitted by law, Pariette Inc. disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy of data, and non-infringement.
14. Limitation of liability
To the fullest extent permitted by applicable law, Pariette Inc. and its officers, directors, employees and agents shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, goodwill, data or business opportunity, arising out of or relating to your use of the site. Our aggregate liability for any claim relating to the site shall not exceed the total amount you paid to us in the ninety (90) days preceding the event giving rise to the claim.
15. Indemnity
You agree to indemnify and hold harmless Pariette Inc. against any claim, demand, loss, liability or expense, including reasonable legal fees, arising from the content you submit, your use of the site, or your breach of these terms or of any law or third-party right.
16. Governing law, disputes and contact
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. The courts located in Delaware shall have exclusive jurisdiction, save for any mandatory consumer protection right you may have to bring proceedings in your country of residence. These terms are executed in English; translations are provided for convenience only and the English text prevails in the event of any discrepancy. Notices and requests: tech@pariette.com.
17. Changes to these terms
We may amend these terms. The version published on this page at the time of your payment applies to that payment. Continued use of the site after a change constitutes acceptance of the amended terms. The date of the current version is shown at the top of this page.
